1. Introduction

These Terms and Conditions ("Terms") govern your use of the HW Wargames, LLC website (hwwargames.com) and your purchases made in-store at our Houston, Texas location (collectively, the "Services"). By placing an order online or making a purchase in-store, you agree to be bound by these Terms. Please read them carefully before completing any transaction.
HW Wargames, LLC is a Texas limited liability company registered in the State of Texas. References to "HW Wargames", "we", "us", or "our" refer to HW Wargames, LLC.

2. Eligibility

By using our Services, you confirm that you are at least 18 years of age, or that you are using the Services under the supervision of a parent or legal guardian who agrees to these Terms. We reserve the right to refuse service to anyone at our discretion.

3. Products and Pricing

3.1 Product Descriptions

We make every effort to ensure that product descriptions, images, and specifications on our website are accurate. However, we do not warrant that descriptions are complete, reliable, or error-free. If a product you receive differs materially from its description, you may return it in accordance with our Returns & Exchanges policy, see section 8.

3.2 Pricing

All prices are listed in US Dollars (USD) and applicable discounts are applied in the cart, when the thresholds are crossed. Prices are subject to change without notice. The price charged will be the price displayed at the time your order is placed.

3.3 States Sales Tax

For online orders sales taxes will be calculated for customer based on their billing address and applied at the checkout. In-store purchases are subject to all sales taxes applicable in Harris county, Texas, at the point of sale.

4. Orders and Payment

4.1 Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including in cases of pricing errors, product unavailability, or suspected fraudulent activity. You will be notified promptly by email if your order cannot be fulfilled.

4.2 Payment

We accept the following payment methods online and in-store:

Major credit and debit cards (Visa, Mastercard, American Express)
HW Wargames gift cards

Payment is processed at the time of purchase for standard orders. For preorders, please refer to Section 5 below.

5. Preorders

When you submit a preorder request through our store, no payment is taken at the time of the request, however this constitutes as an offer to purchase. Invoices will be issued and payment collected in-store on the Saturday of the applicable release date.

Preorder requests submitted after Tuesday at noon, following the relevant Warhammer Community announcement, will be processed after the release date, subject to stock availability. We cannot guarantee fulfilment of late preorder requests.

For online only products, your order will be placed with our supplier on the Saturday of the preorder window. These items will be shipped by Games Workshop to us on or after the release date. You will be contacted as soon as your order arrives and is ready for collection or dispatch.

HW Wargames reserves the right to cancel preorder requests in the event of supply issues, discontinuation, or circumstances beyond our control. No payment will have been taken in such cases.

6. Shipping and Delivery

6.1 Shipping Area

We ship to addresses within the contiguous United States (lower 48 states) only. We do not ship to Alaska, Hawaii, US territories, or internationally.

6.2 Shipping Costs

Orders below $100 are charged at a flat rate of $10, between $100 and $150 a flat rate of $7 and free shipping on all orders over $150. Shipping charge are displayed at checkout.

6.3 Dispatch and Delivery Times

Orders are typically dispatched within 1-2 business days of payment being received. Estimated delivery times are 3-5 business days from dispatch, depending on your location. These are estimates only and are not guaranteed. If ordering out of stock items please see FAQ, here.

6.4 Risk of Loss

Title and risk of loss for products pass to you upon delivery to the carrier. HW Wargames is not responsible for delays, damage, or loss caused by the carrier after dispatch. Please contact us within 48 hours of delivery if your order arrives damaged or incorrect.

7. Click & Collect / In-Store Pickup

Customers may select click & collect at checkout to collect their order from our Houston, Texas location at no shipping charge. You will receive a notification when your order is ready. Our order will be held as long as you require, you have paid for it. However, with no communication after 30 days the order will be cancelled and a refund will be isued. Please contact us if you require additional time or have any questions or concerns.

8. Returns and Exchanges

8.1 Eligibility

We accept returns on unopened, undamaged products in their original packaging within 20 days of the date of delivery. To initiate a return, please contact us before sending any item back.

8.2 Non-Returnable Items

The following items are not eligible for return or exchange:

Opened or assembled miniature kits
Painted or partially painted miniatures
Digital products or downloadable content
Gift cards
Items marked as final sale

8.3 Damaged or Incorrect Orders

If your order arrives damaged or you receive an incorrect item, please contact us within 48 hours of delivery with photographic evidence. We will arrange a replacement or refund at our discretion.

8.4 Refunds

Approved refunds will be processed to your original payment method within 5-10 business days of us receiving the returned item within the 20 day window, see section 8.1 above. Refunds received after that date will be refunded as store credit at our discretion. Shipping costs are non-refundable unless the return is due to our error.

9. Gift Cards

HW Wargames gift cards are available for purchase in-store and online. Gift cards:

Do not expire
May be used across multiple transactions until the balance is exhausted
Are redeemable in-store and online
Are non-refundable and cannot be exchanged for cash
Are not replaceable if lost or stolen

10. Discount Programme

HW Wargames operates a tiered discount programme for customers registered to our mailing list, savings offered are based on total order value in the cart, excluding tax and shipping:

Orders up to and including $100 receive a 5% discount
Orders above $100 and up to an including $150 receive an 8% discount
Orders above $150 receive a 12% discount

These programme details are also provided upon registration to the mailing list. We reserve the right to modify, suspend, or terminate the discount programme at any time with reasonable notice to affected customers.

Items not eligable for discounts inculde, but are not limited to:

Events tickets
Selected Games Workshop products invcluding: Made to order or print items, limited edition products, Forge World/ Expert Kits (15+) and merchendise items

11. Intellectual Property

All content on the HW Wargames website, including text, images, logos, and graphics, is the property of HW Wargames, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our website without our prior written consent.

Product names, faction names, and associated imagery relating to Games Workshop products are trademarks of Games Workshop Limited. HW Wargames is an independent retailer and is not affiliated with or endorsed by Games Workshop Limited.

12. Limitation of Liability

To the fullest extent permitted by applicable law, HW Wargames, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our Services or purchase of our products, including but not limited to loss of data, loss of profit, or business interruption.

Our total liability to you for any claim arising from a transaction shall not exceed the amount paid by you for the product or service giving rise to the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Harris County, Texas.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Your continued use of our Services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
